TERMS AND CONDITIONS OF SERVICE

  3. I agree to be legally bound by these terms
  4. I accept electronic delivery of all future communications
  5. I understand my payment method will be charged according to these terms
  6. I waive any claims regarding non-receipt of electronic communications

TERMS AND CONDITIONS
  1. CUSTOMER APPRECIATION
Thank you for choosing Bin-Drop Waste Services. We are dedicated to ensuring your dumpster rental experience is smooth and hassle-free while providing exceptional service.
  1. PROPERTY DAMAGE LIABILITY WAIVER
Customer acknowledges that delivery, drop-off, or retrieval of dumpsters involves inherent risks of property damage that are both foreseeable and unforeseeable. By directing Bin-Drop to place or pickup containers on their property, Customer:
  • Accepts all risks associated with dumpster placement and removal
  • Agrees Bin-Drop shall not be liable for any damage to property including but not limited to lawns, landscaping, pavements, curbs, sidewalks, utilities, driveways, or underground storage tanks
  • Waives all claims for property damage arising from normal dumpster operations
  1. CONTAINER CONDITION AND DAMAGE RESPONSIBILITY
  • Customer must inspect container condition upon delivery and immediately report any pre-existing damage
  • Customer is fully responsible for any damage to the container while in their possession, including but not limited to fire, theft, door damage, welding damage, paint damage, or any other harm
  • All repair costs will be charged to the customer's credit card on file
  1. CONTAINER MOVEMENT PROHIBITION
  • Customer cannot move or authorize anyone to move any container without Bin-Drop's express written permission
  • Unauthorized movement voids all warranties and Customer assumes full liability for any resulting damage
  • If relocation is necessary, Bin-Drop will schedule the move and charge $250.00 bin moving fee to the credit card on file
  1. PROPERTY ACCESS RIGHTS
  • Bin-Drop has the irrevocable right to enter Customer's property for delivery, pickup, maintenance, and regulatory compliance (including NJDEP decal updates)
  • Customer grants Bin-Drop an easement for container-related operations
  1. ACCESS REQUIREMENTS AND OBSTRUCTION FEES
  • Customer must provide unobstructed access on delivery and pickup days
  • If delivery or pickup cannot be completed due to obstruction, Customer's credit card will be charged $250.00 attempt fee per occurrence
  • "Obstruction" includes but is not limited to vehicles, debris, construction materials, or any impediment to truck access
  1. PROHIBITED MATERIALS AND HAZARDOUS WASTE
Customer is STRICTLY PROHIBITED from placing the following materials in any container:
  • Hazardous materials: gas/fuel, oil, antifreeze, paint, asbestos, chemicals (pesticides, fertilizers, cleaning products, mercury-containing items, pool chemicals, turpentine, weed killers)
  • Municipal waste, contaminated waste or soil, incinerator ash, septic waste, sewage sludge
  • Batteries, liquids, brick, concrete, rocks, dirt, ash, plant material
VIOLATION CONSEQUENCES:
  • Customer assumes full liability for all costs associated with hazardous/prohibited waste disposal
  • Minimum penalty of $350.00 will be imposed, plus actual cleanup costs
  • Customer indemnifies Bin-Drop against all claims, damages, and regulatory penalties
  • Cleanup costs include but are not limited to dumpster decontamination, truck cleaning, equipment replacement, and employee safety gear
  1. FILL LINE COMPLIANCE AND OVERWEIGHT CHARGES
  • Customer must observe the fill line marked on the container
  • Overfilled containers cannot be retrieved until excess material is removed
  • Each pickup attempt for overfilled/overweight containers results in a $250.00 charge
  • For overweight containers: Customer must reduce weight or rent additional container at full price
  • Load balancing fee: $250.00 per hour if Bin-Drop must redistribute weight
  • Overweight tonnage fee: $130-$150 per ton (prorated) charged at pickup
  1. CANCELLATION AND SCHEDULING POLICIES
  • Cancellations within 24 hours of scheduled delivery incur $250.00 scheduling adjustment charge
  • Cancellations more than 24 hours in advance receive full refund
  • Priority deliveries/pickups incur additional $250.00 charge
  1. RENTAL PERIOD AND EXTENSIONS
  • Standard rental period: 7 days including delivery, pickup, and disposal
  • Extensions beyond 7 days incur additional daily fees
  • Bin-Drop reserves the right to retrieve containers after 10 days regardless of Customer preference
  1. PAYMENT AND BILLING TERMS
  • Credit cards charged in full prior to delivery
  • Additional charges (overweight, violations, fees) will be charged to card on file
  • Updated receipts will be provided for additional charges
  • Fuel surcharge applies to all orders as separate line item
  1. ELECTRONIC COMMUNICATIONS AND DELIVERY
Customer expressly agrees that:
  • All electronic signatures are valid and binding
  • Email delivery constitutes legal notice equivalent to certified mail
  • Customer is responsible for maintaining current email address and monitoring all folders
  • Spam filter issues do not void Customer's obligations under these terms
  • All documents (invoices, notices, terms) may be delivered electronically
  1. DISPUTE RESOLUTION AND GOVERNING LAW
  • These terms are governed by New Jersey law
  • Any disputes subject to binding arbitration
  • Customer waives right to jury trial
  • Customer responsible for all collection costs and attorney fees
